Terms of Service & License Agreement

1. Acceptance and Scope

These Terms govern your use of the Fortaify website, product pages, accounts, subscriptions, installers, and applications, including the Glyph desktop and mobile applications. They incorporate our Privacy Policy by reference. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Who We Are

"Fortaify," "we," "us," or "our" refers to Fortaify, the provider of the Services, operated by Tao Creative Labs LLC. Glyph is our AI application. Third-party AI models, datasets, and open-source components are owned by their respective licensors and are provided subject to their own licenses.

3. Eligibility and Accounts

The Services are not directed to children under 13, and you may not use them if you are under 13. If you are between 13 and the age of majority in your jurisdiction, you may use the Services only with the involvement of a parent or legal guardian who agrees to these Terms. Account creation and paid subscriptions are intended for users who are at least 18 years old or who have verifiable parental or guardian consent.

Some features require a Fortaify account (for example, subscription management and cross-device sync). You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that occurs under your account. Notify us promptly at support@fortaify.com of any unauthorized use.

4. License to Use Glyph

Subject to your compliance with these Terms and any applicable plan limits, Fortaify grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use Glyph on devices you own or control, for your personal or internal business use.

• You may not copy, distribute, sublicense, rent, lease, sell, or commercially exploit the Services except as expressly permitted.
• You may not reverse engineer, decompile, or disassemble proprietary portions of the Services, except to the extent that applicable law expressly permits despite this limitation.
• You may not remove proprietary notices, circumvent security or license controls, or use the Services to build a competing product.
• You may not use any integrated third-party model, template, or dataset in a manner that violates its own license or commercial terms.

5. App Store Licensed Application Terms

When you obtain Glyph through the Apple App Store or Google Play (each, an "App Store"), the following also apply. These Terms are between you and Fortaify only, and not with the App Store, and Fortaify (not the App Store) is solely responsible for the application and its content.

• Scope of license: Your license is limited to a non-transferable license to use Glyph on Apple- or Android-branded devices you own or control, as permitted by the applicable App Store usage rules.
• Maintenance and support: Fortaify is solely responsible for providing maintenance and support for Glyph. The App Store has no obligation to furnish any support services.
• Warranty: Fortaify is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Glyph fails to conform to any applicable warranty on the Apple App Store, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Product claims: Fortaify, not the App Store, is responsible for addressing claims relating to Glyph, including product liability, legal or regulatory non-compliance, and consumer protection claims.
• Intellectual property claims: Fortaify is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to Glyph.
• Legal compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary: You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

6. Subscriptions, Billing, and Cancellation

Glyph offers an optional auto-renewable subscription ("Glyph Pro") that unlocks additional features. Current subscription titles, durations, and prices are displayed in the app and at the point of purchase.

• Auto-renewal: Subscriptions renew automatically for the same term at the then-current price unless you cancel at least 24 hours before the end of the current period. Payment is charged to your App Store or Google Play account at confirmation of purchase and at each renewal.
• Managing and cancelling: You can manage or cancel your subscription in your App Store or Google Play account settings after purchase. Deleting the app does not cancel a subscription.
• Free trials and offers: If a free trial or introductory offer is provided, any unused portion is forfeited when you purchase a subscription, where applicable. Unless you cancel before the trial ends, the subscription converts to a paid term at the disclosed price.
• Price changes: We may change subscription pricing prospectively. Where required, we will give notice and, where required, obtain your consent before a change takes effect.
• Refunds: Purchases made through an App Store are subject to that store's payment, refund, and cancellation policies, which govern those transactions. For purchases made directly through Fortaify, our posted refund practices and applicable law apply.
• Enterprise plans: Glyph Enterprise and Enterprise Regulated are not self-service subscriptions. They are provided under a separate written agreement and order form covering term, seats, entitlements, and any deployment or compliance commitments. Pricing shown on our website is a planning reference, not an offer or a quote. No consumer purchase, in-app upgrade, or app-store subscription activates an enterprise entitlement, Healthcare Data Mode, or a Business Associate Agreement.

7. On-Device Processing and Your Content

Glyph is designed to run AI inference and most generation on your device. When you use a local model, your prompts, conversations, attached documents and images, retrieval (RAG) sources, memories, and downloaded models stay on your device and are not transmitted to Fortaify for that processing.

Some features send content off your device, and you choose whether to use them. Selecting a cloud AI model sends your prompt and any context you include to that provider under its own terms. Internet search and page fetching send your query to a search provider and request pages from the sites you open. Local-network sync moves content directly between your own devices. Cloud Relay, which lets your phone reach your desktop from outside your network, stores the messages in our infrastructure until your desktop collects them. Our Privacy Policy describes each of these in detail.

You retain all ownership rights you already hold in the content you input and in the output you generate, subject to applicable law and to the licenses of any third-party model used to produce it. You are solely responsible for the content you provide and create and for ensuring you have the rights to use it.

8. AI-Generated Content

Output produced by AI models is probabilistic and may be inaccurate, incomplete, offensive, or otherwise inappropriate, and it may not reflect current information. You are responsible for evaluating output and for any use you make of it.

• Do not rely on output as a substitute for professional advice, including medical, legal, financial, or safety-critical advice.
• You are responsible for verifying output before relying on, publishing, or acting on it.
• Glyph includes an in-app mechanism to report or flag AI output you consider offensive or harmful, and we use those reports to help improve safety and filtering.

9. Acceptable Use

You agree not to use the Services to:

• Violate any law or regulation or infringe the rights of others.
• Generate or distribute malware, phishing, credential-theft tooling, or unauthorized surveillance tools.
• Harass, threaten, defame, or impersonate others, or create deceptive or non-consensual synthetic media.
• Create, solicit, or distribute child sexual abuse material or any content that sexualizes or endangers minors.
• Generate content that promotes self-harm, terrorism, or serious violence.
• Use output in regulated or high-risk decisions without appropriate legal and human-review safeguards.
• Circumvent security measures, usage limits, or the license terms of any integrated model or service.

10. Third-Party Models, Services, and Open Source

Glyph supports third-party open models and libraries and integrates third-party services such as authentication providers, model repositories, hosting, analytics, and payment processors. Your use of those components is governed by their own terms and licenses in addition to these Terms. Fortaify grants no rights to any third-party model beyond what its licensor grants, and third-party terms may change independently of Fortaify. Open-source components are provided under their applicable open-source licenses.

11. Organization and Enterprise Accounts

If you are given access to the Services through an employer, school, firm, or other organization under a Glyph Enterprise agreement, additional terms apply to that use.

• Administration. Your organization administers its account. Its administrators may assign and revoke seats, enroll and revoke devices, publish security policy that your enrolled device enforces, set retention for content on those devices, and receive metadata about policy decisions as described in the Privacy Policy. Content you create in an organization account may be subject to your organization's policies rather than your own preferences.
• Authority. If you accept these Terms on behalf of an organization, you represent that you are authorized to bind it. The individual accepting an order form binds the organization to it.
• Order of precedence. Where a signed enterprise agreement or order form conflicts with these Terms, that agreement controls for the organization's use.
• Activation. Enterprise entitlements, Healthcare Data Mode, and Business Associate Agreements are issued by us after contracting and any required compliance review. They cannot be enabled by a client setting, a consumer purchase, or a support request.
• Security controls are not a compliance guarantee. Glyph Enterprise provides controls that inspect content before it is transmitted, restrict destinations, and record decisions. Detection is a layered heuristic and is not guaranteed to identify every sensitive value. You remain responsible for configuring policy appropriately, for your own regulatory obligations, and for validating that the configuration meets them. Nothing in the Services constitutes legal or compliance advice, and labels you apply to your content reflect your determination rather than ours.
• Termination. When an organization's agreement ends or your membership is removed, access to organization resources ends and cached organization policy and regulated content may be removed from enrolled devices.

12. Intellectual Property

Fortaify and its licensors retain all right, title, and interest in and to the Services, including the software, user interface, design, trademarks, and brand assets. Except for the limited license granted to you, no rights are transferred. All rights not expressly granted are reserved.

13. Feedback

If you send us feedback, suggestions, or ideas, you grant Fortaify a perpetual, irrevocable, worldwide, royalty-free license to use them to operate and improve the Services, without obligation or compensation to you.

14. Privacy

Our Privacy Policy explains how we handle account data, diagnostics, and other information, and how on-device content is kept on your device. You can request deletion of your account and associated personal data at fortaify.com/delete-account.

15. Service Availability and Changes

We may add, change, suspend, or discontinue features to improve reliability, compatibility, security, or the product, and we may release updates. We are not liable for changes to or discontinuation of any feature, except as required by law or an active paid entitlement.

16. Suspension and Termination

You may stop using the Services at any time and may delete your account. We may suspend or terminate access for violations of these Terms, safety or security risks, non-payment, or legal requirements. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution.

17. Disclaimers of Warranty

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that AI output will be accurate or reliable.

18. Limitation of Liability

To the maximum extent permitted by law, Fortaify and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to the Services. Our total aggregate liability for all claims relating to the Services will not exceed the greater of the amount you paid to Fortaify for the Services in the six months before the event giving rise to the claim, or fifty U.S. dollars (US$50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

19. Indemnification

You agree to defend, indemnify, and hold harmless Fortaify from and against claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your content, your use or misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.

20. Governing Law

These Terms are governed by the laws of the United States and the State in which Tao Creative Labs LLC is organized, without regard to conflict-of-law rules. Subject to the section below, the state and federal courts located in that state will have jurisdiction over disputes not subject to arbitration.

21. Dispute Resolution and Arbitration

Please read this section carefully. To the extent permitted by applicable law, you and Fortaify agree to first try to resolve any dispute informally by contacting support@fortaify.com. If a dispute is not resolved within 30 days, you and Fortaify agree to resolve it through binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court.

To the extent permitted by law, you and Fortaify waive the right to a jury trial and the right to participate in a class or representative action. Nothing in this section prevents you from raising a dispute with a relevant government agency, and it does not apply where prohibited by the mandatory law of your jurisdiction.

22. Export Compliance

You agree to comply with all applicable export control and sanctions laws and not to export, re-export, or use the Services in violation of those laws.

23. Changes to These Terms

We may update these Terms to reflect legal, product, or safety changes. We will update the effective date above and, for material changes, provide reasonable notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
